这个是我的雇佣合同,只字不提周工时,超过44小时如何计算,大家看看,现代版的卖身契。比起我再国内的合同,还简略,防护措施,培训,一概全无。
我就奇怪了,如果是雇佣新加坡人,难道雇主也是这个合同?

EMPLOYMENT CONTRACT
1.行业职位/Appointment
我们很高兴聘请你在本公司担任仓库助理,按新加坡劳工部批准的合同期2年,
(自劳工部IPA批文算起), 聘用条款如下:
We are pleased to offer you the position of Logistics Coordinator with our Company, according to Singapore Ministry of Manpower regulations for a period of two (2) years under ‘S’ Pass scheme. (effective upon IPA approved) on the following terms and conditions:
2.薪金/Salary
你每月的收入为两千零一十元 (SGD2010)。每月将从你的薪金中扣除一百新元(SGD100) 用于支付你的个人所得税或因为你的行为失当而被遣返的费用。若你已根据新加坡税法缴清你的税,余额将在你完成两年(2)的合约后返还给你。
Your basic salary will be SGD $2010.00. A sum of $100/- would be deducted from your salary each month to be used to offset any income tax owing by you or for your repatriation for misconduct. The deductions will be refunded to you upon completion of your contract, provided there are no outstanding taxes owning by you to the Singapore tax authorities.
4.工作时间/Working Hours
你的工作时间是为每天12小时,每周工6天。
Your working hours is based on 12-hour shift per day, 6 days a week.
5.医疗福利/Medical Benefits
公司会提供你医疗福利,但必须要在公司指定的医生处接受诊疗才可以报销医药费用。每次最高报销限额为门诊费用的七十巴仙(70%)。每个日历年度最高限额为一百五十新元(SGD150)。
You are eligible to claim reimbursement of cost of medical consultation, treatment & medical at our Company’s panel of doctors subjected to a maximum of 70% claim per consultation up to maximum of S$150.00 (Dollar One Hundred and Fifty Only) per calendar year.

6.假期,病假和公共假期/Vacation, Sick Leave and Public Holidays
当你为公司服务满十二个月后, 你将享有九天的有薪年假。
You will be entitled to 9 days paid annual leave for every 12 months’ service with the company.
若你的一些疾病/伤不是因为你的失误直接或间接引起的,公司将提供你到指定医生处接受治疗并提供你所述的医疗福利。
You are entitled to the medical benefits as stated for medical treatment by its appointed doctor/s provided such treatment is not in connection with any illness/ disease directly or indirectly caused by your misconduct.
你每年将享有十四天的有薪病假,和六十天的住院假。
Sick Leave entitlement per year is 14 days’ paid medical leave and 60 days if hospitalization is required.
你将享有新加坡政府公布的公共假期。
You will be entitled to public holidays gazetted by the Singapore Government.
7.保险/Insurance
你将根据新加坡劳工赔偿法投保在工作中的意外险。
You will be insured against any accident at work in accordance with the Workmen Compensation Act of Singapore.
8.限制条款/Restrictions
你必须遵守新加坡共和国的法令和公司的规章制度。
You will abide by the laws of the Republic of Singapore as well as the Company’s Rules and Regulations at all time.
你同意在受雇期间,将你的护照交给公司妥善保管。
You hereby agree to have your passport retained by the Company for safe custody during your employment with us.
只有当你到达新加坡并通过当地医生的体检时,该合同才生效。如果你没有通过新加坡的体检,你将被即可遣返回中国。
Your appointment will be subject to your passing the required medical examination in Singapore. Failing to pass the medical examination will mean immediate repatriation.
9.终止合同/Termination of Service
若你要辞职,你必须提前1个月以书面形式通知公司或赔偿公司相当于1个月的薪金代替通知。公司若要辞退你,也需要给出1个月的书面通知,或相等于1个月的薪金赔偿。
In the event that you wish to terminate your services with the company you will have to give the Company 1 month written notice of resignation or 1 month salary in lieu of notice. Vice-versa, should the company wishes to terminate your services, the Company will have to give 1 month written notice or 1 month salary in lieu of notice.

然而,在下列情况下,公司有权即刻终止合同而无需提前通知或支付通知金:
The Company, however, reserves the right to terminate your employment without notice and without compensation on the following grounds:
重大失误或违反公司的规章制度,或触犯新加坡法律。
Gross misconduct or breach of any of the Company’s Rules and Regulations or breach of any laws of the Republic of Singapore.
你卷入其他雇佣关系/商业交易或为公司以外的其他人服务。
Engaging in any other employment/ business or work for any one other than the Company.
因为你的行为不端直接或间接导致生病而无法胜任工作。
Incapacitation by sickness or disease caused directly or indirectly by your misconduct.
合同期内,经公司医生检查认定你的身体健康状况不合适在新加坡工作。
Certified by the Company’s doctor/s as unfit for work in Singapore during the contract period.
无法通过试用期。
Fail your probationary period
受雇用期间,你的工作表现不合格,或行为不端。
Unsatisfactory performance and/or misconduct at any time during your contract.
未经批准,连续旷工两天。
Failure to report for work for a continuous period of 2 days without permission.
新加坡政府取消你的工作准证。
Work permit cancelled by the Singapore Government。
提供虚假资料或文件。
Given false/misleading information and forgery of documents.
打架和盗窃。
Fighting and Stealing。
合同届满前,如因为你的失误而被遣返,你要自己承担遣返机票费
You will bear the cost of the air-ticket if you are repatriated for misconduct before the expiry of your two years contract.
10.工作准证的延期/Renewal of ‘S’ Pass
两年合同一旦完成,只要你的工作表现达到公司的要求,公司可能同你续约,延长你的工作准证一年;但是,你有权决定是否要续约。
Upon completion of your two years contract, the Company may renew your ‘S’ Pass for another one year if it is happy with your work performance. However, you have the right to decide whether to renew your contract.

11.住宿/Accommodation
你必须保持宿舍卫生清洁以及严格遵守以下的条规:
Proper housekeeping must be maintained at all times. You are required to abide strictly by the following rules :
宿舍仅限公司的雇员居住,任何人的亲戚/朋友不得进入或留宿。
The accommodation is strictly for the Company’s employees. No relatives and friends are allowed to visit or stay-in.
不得在宿舍里赌博、抽烟和酗酒。
No gambling, smoking and drinking of alcohol are allowed.
煮饭和洗衣服必须在宿舍指定的范围内。
Cooking and laundry must be done at the proper places within the premises.
垃圾必须按正确的方式处理。
Rubbish must be disposed in the proper manner.
维修/维护宿舍的开销将有你们自己承担。
You should be fully responsible for all expenses incurred to relating to the maintenance of the accommodation.
如果宿舍的设备有被损坏,你们必须承担维修的责任。
You should be responsible for any damages to the flat.
每时每刻保持宿舍厕所卫生、干净。
To maintain flat’s toilets clean and hygienic at all time.
在你的电脑中只使用合法软件。
To install and use only legal software in your personal PC
自觉遵守宿舍公约,该公约可能随时修订。
Any other rules and regulations imposed from time to time.
12.个人卫生习惯/Personal Grooming and Hygiene
着装要保持整齐。
Maintain proper Attire.
保持个人卫生整洁干净。
Keep good personal hygiene and cleanliness.
不留长发,也不得染头发。
Maintain clean haircut and no hair coloring.
不允许纹身。
No Tattoo is allowed.

13.伙食/其他公用器具的费用/Food & Other Utilities Charges
你必须自己承担伙食费和所居住宿舍每月的租金及水电费等。
You shall be fully responsible for your own meals and the utilities charges incurred each month in respect of the accommodation provided.
14.工作责任范围/Duties and Responsibilities:
• 必须负责所有同仓储后勤业相关的职责
Responsible for all work and general related to company’s warehouse and logistics.
• 把化学液体灌入铁皮桶里
Working and assisting in the drumming process
• 货物装卸、打包、拆包、包装
Responsible for Loading/Unloading of goods, Packaging/Un-packaging of goods, Container stuffing and de-stuffing.
• 根据包装单点算和核对货物数量
Stock-counting according to the packing list and check the quantity of goods
• 操作搬运设备,例如开叉车
Effectively operating lifting equipments, machines and forklift
• 设备与设施的清洁和维护
Maintaining the cleanliness of the warehouse and company’s equipment
必须听从并完成主管安排的货仓日常事务及其他工作
• Diligently completing other operational tasks assigned by superiors

15. 死亡/Death
万一发生死亡事故,公司有绝对权利决定是否将尸体在新加坡火化或将尸体送回中国。
In the event of death, the Company has sole discretion to either cremate or send your body intact back to China.
16. 适用法律/Jurisdiction
本雇用合同受制于新加坡共和国法律。
This employment contract is subject to the Laws of the Republic of Singapore.

即使同一个公司,不同职位的合同也不一样,外国雇员和本地雇员也不一样。本地的不涉及宿舍等,至于年假和医疗保险,即使都是新加坡公民,职位高低也不一样,我们老大还有房子和车,一年回国度假2次,子女全部的国际学校学费(包括学校旅行),以及全家的医疗保险,这种东西没办法比较。
新加坡本来就是雇主老大啊,这点要有心理准备(美其名曰:亲商),如果不能接受合同,就不要签。

您挨得了多久。
新加坡劳工法律,在薪资新币2500以下的,每星期工作时间是44小时,如加班的话的给加班费。
EMPLOYMENT ACT
(CHAPTER 91)
(2) Any person employed in a managerial or an executive position who is in receipt of a salary not exceeding $2,500 a month (excluding overtime payments, bonus payments, annual wage supplements, productivity incentive payments and any allowance however described), or such other amount as may be prescribed by the Minister, shall be regarded as an employee for the purposes of —
(a) sections 20, 20A, 21, 22, 23 (read with section 10 or 11, as the case may be), 24, 25 and 34 and Parts XII to XVI (read with the Second and Third Schedules); and
(b) such other provisions of this Act as the Minister may, by regulations, specify,
and those provisions shall apply in relation to that person subject to such modification as may be prescribed.

主要就是工作时间太长了,别的都还Ok啦
还好拉….规矩是死的人是活,跟你的同事先搞好关系,努力工作就好了,不要想那么多,出国不是享受啊.,.,.
每周72小时已经是极限了,不可能再有加班。。。
除了工作时间和护照,合同的基本条件都不差,没有人逼着你签,所以也就不算卖身契了。
关键的,现在从国内过来,做的工作没什么技术性,能拿到2000多的工资,工作时间也不可能限制在44个小时之内。
